Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the GoCreative.AI website, chat widget, contact forms, and related services (collectively, the "Services"), operated by Bears and Bulls, LLC d/b/a GoCreative.AI ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
2. Description of Services
GoCreative.AI is an AI consulting and software-as-a-service (SaaS) company providing AI-powered lead generation, advertising management, marketing automation, and related consulting services. Specific deliverables, pricing, and scope of any engagement will be defined in a separate written service agreement, proposal, or statement of work.
3. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.
4. Accounts & Communications
When you opt in through our chat widget, contact forms, or booking pages, you authorize us to contact you by email, phone, and SMS regarding our Services. You agree that the contact information you provide is accurate and that you are authorized to provide it.
SMS messaging is governed by our Privacy Policy. You may opt out of SMS messages at any time by replying STOP.
SMS Messaging Terms
By providing your phone number through any of our forms (including Facebook Lead Generation forms, our chat widget, contact forms, or booking pages), you expressly consent to receive SMS messages from GoCreative.AI (operated by Bears and Bulls, LLC) at the phone number provided. Messages may include:
- Initial consultation outreach and scheduling
- Appointment confirmations and reminders
- Follow-up messages after missed calls or appointments
- Marketing communications about our services
- Booking links and resource sharing
Message frequency: You may receive 1 to 5 messages per week, depending on your engagement and stage in our sales process.
Message and data rates may apply. Standard carrier charges apply for all messages sent or received. We do not charge for the messages, but your wireless provider may.
To opt out: Reply STOP at any time to unsubscribe from all future SMS messages. You will receive a one-time confirmation message that you have been unsubscribed.
For help: Reply HELP to any message for assistance, or contact us directly at contact@gocreativeai.com.
We will never share your phone number or SMS opt-in data with any third party for marketing or promotional purposes.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful, fraudulent, or harmful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Reverse engineer, decompile, or copy our proprietary software, AI models, or systems
- Submit false, misleading, or inaccurate information
- Use the Services to send spam or unsolicited communications
6. Fees & Payment
Fees for paid Services will be set forth in your individual service agreement or order form. Unless otherwise stated, all fees are non-refundable, due upon receipt, and exclusive of applicable taxes. Late payments may result in suspension of Services and additional fees as specified in your agreement.
7. Intellectual Property
Our Property: GoCreative.AI and its licensors retain all rights, title, and interest in and to the Services, including all software, AI models, proprietary methodologies, designs, branding, and content. No license or ownership rights are transferred to you except as expressly stated in a written agreement.
Your Content: You retain ownership of materials you submit to us. You grant us a limited, non-exclusive license to use such materials solely to provide the Services to you.
8. AI-Generated Output Disclaimer
Our Services use artificial intelligence to generate content, recommendations, and insights. AI output is provided "as is," may contain inaccuracies, and should be reviewed by a human before use. We make no warranty regarding the accuracy, completeness, or fitness of any AI-generated output for a particular purpose.
9. No Performance Guarantees
We do not guarantee any specific business outcome, including revenue, leads, return on ad spend, or sales. Results depend on many factors outside our control, including market conditions, your sales process, advertising budget, and platform changes by third parties such as Meta and Google. Any case studies, testimonials, or examples are illustrative only.
10. Third-Party Services
The Services may integrate with or rely on third-party platforms (such as Meta, Google, Stripe, and others). We are not responsible for the availability, terms, policies, or performance of those third-party services.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOCREATIVE.AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to defend, indemnify, and hold harmless GoCreative.AI and Bears and Bulls, LLC, and their respective officers, employees, and affiliates, from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will survive.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date will reflect any changes. Continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
